1. Agreement to These Terms

These Terms of Use ("Terms") govern your use of www.globalxploration.com (the "Site") and any purchases made through our online shop. The Site is operated by Global Xploration ("Global Xploration," "we," "us," or "our").

By accessing the Site, contacting us through it, or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. You must be at least 18 years old, or the age of majority where you live, to place an order.

2. Using the Site

You may use the Site for lawful, personal, and legitimate business purposes. You agree not to:

• copy, scrape, or harvest content or data from the Site by automated means;

• interfere with the Site's operation, security, or servers, or attempt to gain unauthorized access to any part of it;

• upload or send viruses, malicious code, spam, or unlawful material;

• impersonate any person or misrepresent your affiliation with anyone;

• use the Site or its content to mislead others about a relationship with Global Xploration; or

• use the Site in any way that violates applicable law.

We may restrict or end access to the Site for anyone who violates these Terms.

3. Our Content and Intellectual Property

The Site and its content, including text, photographs, video, graphics, logos, project names, the Global Xploration and GlobalX names and marks, and the design of the Site, belong to Global Xploration or its licensors and are protected by copyright, trademark, and other laws.

You may view and share links to the Site and print pages for personal reference. You may not copy, reproduce, modify, distribute, or use our content or marks for commercial purposes without our written permission. Product names and trademarks of other companies shown on the Site belong to their respective owners.

4. Project and Expedition Information

Descriptions of projects, expeditions, technologies, and operations on the Site are provided for general informational purposes. Project scope, locations, timelines, partners, and status may change, and some projects described may be proposed or in development rather than active.

Nothing on the Site is an offer to sell, or a solicitation of an offer to buy, any security, investment, or interest in any project, artifact, or recovered material. Nothing on the Site guarantees any discovery, recovery, financial return, or outcome. Any business relationship, investment, or partnership with Global Xploration exists only under a separate written agreement signed by both parties.

5. Inquiries, Submissions, and Feedback

You are welcome to contact us about projects, partnerships, media requests, or services. Please do not send confidential or proprietary information unless we have both signed a written non-disclosure or confidentiality agreement.

Ideas, research, locations, coordinates, historical information, proposals, or other materials you send without such an agreement are not confidential. You keep any ownership rights you have in them, but sending them does not create a partnership, employment, finder's fee, compensation, or other obligation on our part. You also acknowledge that Global Xploration conducts its own independent research and may already be working on, or may later pursue, projects similar to what you submit. This protects both sides: you decide what you share, and we avoid disputes over unsolicited material.

6. Online Store

Products and descriptions. We try to describe and display products accurately. Colors, fit, and appearance may vary slightly because of screen settings and normal variation in printed, embroidered, and manufactured goods. Some products are produced on demand by third-party fulfillment partners.

Pricing and availability. Prices are listed in U.S. dollars and may change without notice. Products may be discontinued or become unavailable. If a product is listed at an incorrect price because of an error, we may cancel the order and refund any payment.

Orders. Your order is an offer to buy. We may accept, decline, or cancel any order, including for suspected fraud, errors, or availability issues. If we cancel an order after you have paid, we will refund you in full.

Payment. Payments are processed by third-party payment providers under their own terms. You agree to provide accurate payment and billing information and confirm you are authorized to use the payment method.

Shipping and risk of loss. Delivery times are estimates, not guarantees. Title and risk of loss pass to you when we deliver the order to the carrier. Taxes, duties, and customs fees for international orders are the buyer's responsibility.

Returns. Returns, exchanges, and refunds are handled under our Shipping & Returns Policy, which is part of these Terms.

7. Third-Party Links and Services

The Site may link to or rely on third-party websites and services, including our website platform, payment processors, shipping carriers, and social media sites. We do not control and are not responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.

8. Disclaimers

THE SITE, ITS CONTENT, AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, GLOBAL XPLORATION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that its information is complete or current.

The Site's content, including historical, technical, and scientific information, is not professional, legal, financial, or investment advice. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GLOBAL XPLORATION AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SITE, ITS CONTENT, OR ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITE OR ANY PRODUCT WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

These limits do not apply where the law does not allow them, including liability for fraud, gross negligence, or willful misconduct.

10. Indemnification

You agree to defend, indemnify, and hold harmless Global Xploration and its owner from any claims, losses, liabilities, damages, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of another person.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Arkansas and applicable U.S. federal law, without regard to conflict-of-law rules.

If a dispute arises, please contact us first. Both parties agree to try in good faith to resolve it informally for at least 30 days before starting any formal proceeding. If it cannot be resolved, it will be brought exclusively in the state or federal courts located in Pulaski County, Arkansas, and both parties consent to the jurisdiction of those courts. Either party may bring a qualifying claim in small claims court instead.

Any claim must be brought within one year after it arises, unless the law requires a longer period.

12. Changes to the Site and These Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms and will revise the "Last updated" date when we do. Changes apply from the time they are posted and do not affect orders already placed. Continued use of the Site after changes are posted means you accept the updated Terms.

13. General

These Terms, together with our Privacy Policy and Shipping & Returns Policy, are the entire agreement between you and Global Xploration about the Site, unless a separate signed written agreement covers a specific matter. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours, including in connection with a change of ownership or business structure.
